In an ongoing unfair prejudice petition presented in the High Court, at extremely short notice we were instructed to prepare an Amended Points of Defence and Counterclaim together with a Witness Statement in support of the client’s application to amend his Points of Defence, less than a week before a hearing was listed to hear the application of the same. The value of the dispute is in excess of £500,000.
The client was and remains a litigant in person; owing to financial constraints our instructions were limited to the task set out above. In order to meet the extremely short deadline, it meant that we had to obtain instructions from the client, collate and review relevant documents in respect of the affairs of a company spanning a 20-year period, and then condense and draft a 28-page Amended Defence and Counterclaim and an accompanying witness statement. It was a significant undertaking given the time constraints. It thus required the team to work around the clock, flexibly and accurately to ensure the deadline was met.
